Expertise

Kate specialises in Court of Protection personal welfare cases and mental health matters, including deprivation of liberty applications, and representation of patients before the mental health tribunal. Kate studied psychology and philosophy at the University of Leeds, followed by her legal qualifications at what was then the College of Law in York. Following a year working in a high street law firm, Kate obtained a training contract at a firm in Birmingham, where she remained for six years after qualification. There, Kate led on Court of Protection personal welfare work, and represented patients before the mental health tribunal. She further advised on community care and public law issues. Kate also advised and represented local authorities, care homes and housing associations in her areas of expertise.

Kate chose to move back to her home county of Yorkshire in 2015 where she continued to grow her practice and caseload solely in the Court of Protection and mental health work at a national firm, before deciding to form MJC Law with Conor Maguire and Lauren Castle. Kate can advise in the following areas:

Proceedings in the inherent jurisdiction of the High Court

Kate accepts instructions from litigation friends, advocates and RPRs as well as family members, other interested parties and detained patients. Kate is a member of both the Law Society’s mental capacity accreditation scheme, meaning she can act as an accredited legal representative, and the Law Society’s mental health accreditation scheme.
