The First-Tier (Special Educational Needs and Disability) Tribunal is a specialist court hearing appeals made by parents or young people to local authority decisions about a child’s or young person’s special educational needs and disabilities.
The Tribunal can hear cases relating to the following matters:
- Refusal to Assess: the local authority has made a decision not to carry out an Education, Health and Care needs assessment.
- Refusal to Issue an Education, Health and Care Plan (“EHC Plan”): an assessment has been carried out, but the local authority refuses to provide an EHC Plan.
- The contents of the EHC Plan: there are disagreements with the description of needs in section B or the provision to meet those needs in section F of the EHC Plan.
- School placement: there is a disagreement about the placement that should be named in section I of the EHC Plan.
- Ceasing the EHC Plan: the local authority decides to stop the EHC Plan.
- Health and social care (extended appeals): the Tribunal has the power to make recommendations relating to health and social care.
