At a time of greater financial pressure within the NHS, it can be more and more difficult to secure funding for specialist and sometimes new innovative treatment even for conditions which may not have mainstream treatments available. A number of legal cases have been decided in recent years which can help people challenge decisions by NHS commissioners to refuse to fund innovative treatment or non-mainstream support. In addition, new treatments and procedures are always being considered by the National Institute for Clinical Excellence (NICE) which makes recommendations to the NHS about decision making in offering non-mainstream or innovative procedures.
Sometimes treatment decisions can be different in different parts of the Country, for example, a person could be provided treatment by a particular NHS Trust only to move from the area and find that another NHS Trust will not fund the exact same treatment. This is called the postcode lottery and should not happen.
